Terms of Service

These Terms of Service (the "Terms") govern the services provided by NETZERO360 Sustainable Waste Solutions, LLC, a California limited liability company ("NETZERO360," "we," "us," or "our") to customers ("Customer," "you," or "your"). By engaging our services, signing a service agreement with us, or using this website, you agree to these Terms.

1. Services

NETZERO360 provides regulated medical waste collection, transport, treatment, and recovery services, plastics recovery services, and related compliance and sustainability reporting services. Specific services, pricing, service locations, and pickup schedules are governed by the individual service agreement executed between NETZERO360 and the Customer (the "Service Agreement"). In the event of any conflict between these Terms and a Service Agreement, the Service Agreement controls.

2. Regulatory Compliance

NETZERO360 operates as a California DTSC-registered hazardous waste transporter, a federally licensed motor carrier (USDOT 4463765), and a California EPA hazardous waste generator (CAL000498564). NETZERO360 manifests, transports, and treats regulated waste in accordance with applicable federal, state, and local law, including the federal Resource Conservation and Recovery Act (RCRA), the California Medical Waste Management Act (Health & Safety Code § 117600 et seq.), and Department of Transportation hazardous materials regulations (49 CFR Parts 171–180).

Customer is responsible for the proper segregation, packaging, labeling, and on-site accumulation of regulated waste prior to NETZERO360's scheduled pickup. Customer represents that all waste tendered to NETZERO360 is as described on the manifest and contains no material outside the categories permitted under the Service Agreement.

3. Manifests and Chain of Custody

Each regulated waste pickup is documented by a Uniform Hazardous Waste Manifest or equivalent state-required tracking document. Customer is responsible for reviewing and signing the manifest at the time of pickup. Once the manifest is signed and the waste is in NETZERO360's custody, NETZERO360 assumes responsibility for transport and treatment consistent with applicable regulations.

4. Fees and Payment

Pricing is established in the Service Agreement. NETZERO360 invoices Customer on the cadence stated in the Service Agreement. Invoices are due within thirty (30) days of the invoice date unless otherwise specified. Past-due balances accrue interest at the lesser of 1.5% per month or the maximum rate permitted by applicable law.

5. Limitation of Liability

To the maximum extent permitted by applicable law, NETZERO360's aggregate liability under these Terms or any Service Agreement, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the total fees paid by Customer to NETZERO360 during the twelve (12) months immediately preceding the event giving rise to the claim. NETZERO360 shall not be liable for indirect, incidental, special, consequential, or punitive damages of any kind, including without limitation lost profits or business interruption. Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct.

6. Indemnification

Customer shall indemnify and hold NETZERO360 harmless from and against any third-party claims, losses, damages, and expenses (including reasonable attorneys' fees) arising out of (a) Customer's breach of these Terms or the Service Agreement, (b) Customer's misclassification or mispackaging of waste, or (c) any material tendered to NETZERO360 that is outside the scope of the Service Agreement.

7. Term and Termination

Either party may terminate a Service Agreement for material breach by the other party that remains uncured thirty (30) days after written notice. NETZERO360 may suspend service immediately if Customer fails to pay undisputed invoices when due, or if continued service would create a regulatory risk.

8. Governing Law and Disputes

These Terms and any Service Agreement are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the services shall be brought exclusively in the state or federal courts located in Solano County, California, and each party consents to the exclusive jurisdiction and venue of those courts.

9. Changes to These Terms

NETZERO360 may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of NETZERO360's services after the effective date of a change constitutes acceptance of the updated Terms.
